´Human French Padel Open 2022' giveaway legal rules and regulations

1. Identification of the organising company.

AGUIRRE Y CÍA, with registered office at (calle Trespaderne 29, 28042, Madrid) and tax identification number B65576878 is organising the draws  "Human French Padel Open 2022".

2. Starting and closing dates and geographical scope of the competitions

The start date of the competition via Instagram will be Wednesday 15 June 2022 and will end on Wednesday 22 June 2022 at 23:59. You will be able to participate and/or vote only during this time period.

AGUIRRE Y CÍA reserves the right to postpone or extend the competition period in the event of force majeure, as well as the right to interpret these legal terms and conditions.

Participation is only possible from Europe.

3. Rules and conditions for participation.

Participation in the competition is open to natural persons aged 18 years or older and residing in Europe.

Employees of the company, family members of employees, fraudulent profiles and competition experts are not eligible to participate in the campaign and therefore cannot be winners.

Participation through agents or third parties, or the use of multiple identities, is also not permitted.

To enter the Instagram giveaway, users must follow @bullpadelsport on the social network INSTAGRAM, follow @bullpadelfrance and follow the player @mdinenno; mention three friends and like the post.

Aguirre y Cía S.A. reserves the right to make changes to the campaign during its development, should any cause arise that prevents it from being carried out successfully or in order to improve its progress.

4. Selection of the winner and mode of the draw

The selection of the winner related to de Instagram giveaway will take place on 22 June 2022, through a platform that will certify that the selection has been randomised among the eligible participants.

There will be 1 winner for each racket and two alternates. A publication will be made on the Instagram of Bullpadel announcing the name of the winner. Also, the winner will be contacted via email and we will send a personal email. If within 5 days he has not answered, the prize will go to the alternate, who will also have 5 days to respond. Once the prize is offered to the alternate, the previous winner will lose the right to claim the prize.

 AGUIRRE Y CÍA is exempt from any responsibility in the event of any error in the data

AGUIRRE Y CÍA reserves the right to declare the prizes invalid in the case that the winners or the designated substitutes do not meet the requirements mentioned in these rules, as well as in the case that the winner and/or substitutes cannot be located.

5. Value and nature of the prize offered.

The prize will be a Vertex 03 Comfort racket with which our player Martin Di Nenno competes. It is valued at 224,95€.

AGUIRRE Y CÍA accepts no responsibility for any possible loss, damage, theft or any other circumstance attributable to the courier services that may affect the delivery of the prizes.

The prize cannot be exchanged for cash or any other prize, nor can it be exchanged or altered. The Company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are problems of stock of the prize and, therefore, it is impossible to give the prize.

6. Information regarding the use of personal data (in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April

●      Sending promotions and subsequent marketing actions in order to promote and disseminate the activities of (AGUIRRE Y CÍA).

6.3. Periods of conservation of the information: The identifying data of participants will be kept for the time strictly necessary for the development of the competition and during the legal periods which, where necessary, are applicable. The data used for advertising and commercial prospecting will be kept indefinitely, unless the user requests (AGUIRRE Y CÍA) to unsubscribe.

6.4. Legal basis for the processing: the legitimacy for the processing of data is the consent given by the participant with the participation in the competition and, therefore, with the acceptance of these terms and conditions. However, in the event of withdrawal of consent, this shall not affect the lawfulness of any processing previously carried out.

6.5. International assignments and transfers: no assignment of data to third companies or international transfers will be carried out. AGUIRRE Y CÍA, as processor of the customer's data, may access and store the data (within the EU) in order to offer the services of its platform to the customer within the framework/agreement/contract established with the customer and only for that purpose.

6.6. Rights of the Participant: Data subjects may exercise their rights of access, rectification, deletion, portability and limitation or opposition of the data in the cases and with the scope established by the GDPR EU 2016/679.  Likewise, you also have the right to withdraw your consent at any time.  To exercise these rights, you may contact (AGUIRRE Y CÍA), through any of the following channels:

7. Sanctions in case of fraudulent use.

Fraud is understood to be the use of independent platforms or applications to obtain votes or more entries in the competition, as well as behaviour that we detect as apparently abusive and/or malicious.

The detection of any of these practices will result in the cancellation of the participation.

AGUIRRE Y CÍA reserves the right to take legal action against those persons who carry out any type of act that could be considered as manipulation or falsification of the competition.

AGUIRRE Y CÍA is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which participation in the promotion takes place, to the defrauding of the usefulness that users may have attributed to it and to the access to the different pages and the sending of participation responses via the Internet.

8. Assignments of image rights and/or intellectual property.

This giveaway is not linked to any social media platform or network.

Instagram does not sponsor, endorse or administer this promotion in any way, nor is it associated with it. The participant is providing their information and data to AGUIRRE Y CÍA and not to Instagram.

9. Acceptance of the Legal Bases.

Participation in the giveaway implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, (AGUIRRE Y CÍA) will be released from the fulfilment of the obligation contracted with this participant.
