Legal basis for the giveaway “4 rackets: Santander Open winners”

1. Identification of the organizer company.

AGUIRRE Y CÍA with fiscal domicile in calle Trespaderne 29, 28042, Madrid and with CIF B65576878 organizes the giveaway “4 rackets: Santander Open winners”.

2. Beginning and ending dates and geographic scope.

The beginning date of the competition will be on Tuesday 11^th of October at 16:00 and it ends on Tuesday 18^th of October at 23:59. It will be possible to participate and/or vote just during that period.

AGUIRRE Y CÍA reserves the right to postpone or extend the competition’s period in case of force majeure, as well as the faculty of interpreting the present legal terms and conditions.

Participating is only possible from Europe.

3. Participation’s rules and conditions.

Participating in the competition will be possible for all those natural persons over 18 years with residence in Europe.

Participating and consequently being winners will not be possible for the company’s employees, employees’ familiars, fraudulent profiles, or competition’s experts.

It is neither allowed the participation through agents, third parties, nor the usage of numerous identities.

To participate, the users must follow on Instagram @bullpadelsport, @navarro_paquito, @mdinenno, @alejandrasalazar9 and @gemmatriay, like the post and mention three users. If the post is shared on Instastories there will be more possibilities of winning the competition.

Aguirre y CÍA reserves the right to make changes on the campaign during its development if something that prevents the giveaway to be correctly done happens, or with the aim of improving its advance.

4. Winner’s selection and giveaway’s modality.

The winner’s selection will be held on Wednesday 19th of October 2022, through a platform which will confirm that the selection has been randomly done among the participants that meets the conditions. 

There will be 4 winners (1 per racket) and 4 substitutes. The winner’s name will be posted on Bullpadel Instagram stories. Also, the winner will be contacted via e-mail, and we will send him a personal mail. If he does not answer in a 5-day period, the prize will pass to the substitute, who will also have 5 days to answer. Once the prize is offered to the substitute, the previous winner will lose his right to claim the prize.

AGUIRRE Y CÍA is exempt from any responsibility in case of an existing mistake in the information provided by the participants that prevents their identification.

AGUIRRE Y CÍA reserves the right to declare the prizes not awarded if the winners or substitutes chosen, do not meet the requirements specified on the basis, as well as in the case of not being able to locate the winner or substitutes.

5. Value and nature of the prize offered. 

The prize consists of a HACK 03 racket valued at 324,95€, a VERTEX 03 COMFORT racket valued at 224,95€, an ELITE W valued at 269,95€, and a FLOW W valued at 224,95€. All of them belonging to the Santander Open winners.

AGUIRRE Y CÍA is not responsible of the possible losses, deteriorations, robberies, or any other circumstance attributable to the delivery service that could affect the prizes shipment.

The prize cannot be exchanged for cash nor any other prize nor can be object of change of alteration. The Company reserves the right to modify the prize if the day of the winner’s selection there exist stock problems and so that the impossibility to deliver the prize.

6. Information relating to the personal data treatment (in accordance with the Regulations (EU) 2016/679 of the European Parliament and the Council, from 27^th of April 2016).

6.2. The aim of the personal data treatment:

●      Managing of the “4 rackets: Santander Open winners” competition, participation, development, and winners’ selection.

●      Publishing them on social media.

●      Creating promotions and later marketing actions with the aim of promoting the AGUIRRE Y CÍA activities.

6.3. Periods of conservation of the information: The identifying data of participants will be kept for the time strictly necessary for the development of the competition and during the legal periods that, where appropriate, and applicable. The data used for advertising and commercial prospecting will be kept indefinitely unless the user requests AGUIRRE Y CÍA to unsubscribe.

6.4. Legal basis for processing: the legitimacy for the processing of data is the consent given by the participant with the participation in the competition and, therefore, with the acceptance of these terms and conditions. However, in the event of withdrawal of consent, this shall not affect the lawfulness of any processing previously carried out.

6.5. International assignments and transfers: no assignment of data to third parties or international transfers will be carried out. AGUIRRE Y CÍA, as processor of the customer's data, may access and store the data (within the EU) in order to offer the services of its platform to the customer within the framework/agreement/contract established with the customer and only for that purpose.

6.6. Rights of the Participant: Data subjects may exercise their rights of access, rectification, erasure, portability and limitation or opposition of the data in the cases and to the extent set out in the GDPR EU 2016/679. 7. Penalties in case of fraudulent use.

It is understood as fraud the use of independent platforms or applications to obtain votes or more participations on the competition, as well as violent behaviors detected.

The verification of any of these practices mean the cancellation of participation.

AGUIRRE Y CÍA reserves the right of taking legal actions against those individuals doing any kind of act that may be considered as manipulation or forgery of the competition.

AGUIRRE Y CÍA is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which participation in the promotion takes place, to the defrauding of the usefulness that users may have attributed to it and to the access to the different pages and sending of participation responses via the Internet.

8. Transfer of image rights and/or intellectual property.

This competition is not linked to any platform or social network.

Instagram does not sponsor, endorse, or administer this promotion in any way, nor is it associated with it. The participant is providing his/her information and data to AGUIRRE Y CÍA and not to Instagram.

9. Acceptance of the Legal Bases.

Participation in the competition implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, consequently, AGUIRRE Y CÍA will be released from the fulfilment of the obligation contracted with this participant.
