Legal basis of the giveaway "Gemma Triay: 3 ELITE rackets"

1. Identification of the organising company.

AGUIRRE Y CÍA, with registered office at C/ Trespaderne 29, 28042, Madrid, Spain, and tax identification number B65576878 is organising the giveaway "Gemma Triay: 3 ELITE padel rackets".

2. Start and end dates of the giveaway and geographical scope.

The giveaway will start on Tuesday 19 July 2022 at 20:00h and will end on Tuesday 26 July 2022 at 23:59h. It will be possible to participate and/or vote only during this period of time. 

AGUIRRE Y CÍA reserves the right to postpone or extend the giveaway period in case of force majeure, as well as the right to interpret these legal terms and conditions.

It will only be possible to participate from Europe.

3. Rules and conditions for participation.

The giveaway is open to all individuals over 18 years of age and living in Europe.

Employees of the company, family members of employees, fraudulent profiles and experts in giveaways may not participate in the campaign, nor may they be winners. 

Participation through agents or third parties or the use of multiple identities is also not permitted.

To enter, users must follow @bullpadelsport and @gemmatriay on Instagram, like the post and mention three users. If the post is shared on Instastories, there will be more chances to win the giveaway. 

Aguirre y CÍA reserves the right to make changes to the campaign during its development, should any cause arise that prevents it from being carried out successfully or in order to improve its progress.

4. Selection of the winner and mode of the giveaway.

The selection of the winners will take place on Wednesday 27 July 2022, through a platform that will certify that the selection has been random among the participants who meet the conditions. 

There will be 3 winners (1 per ELITE racket drawn) and 3 alternates. A publication will be made on the Instagram of Bullpadel announcing the name of the winner. Also, the winner will be contacted via email and we will send a personal email. If within 5 days has not responded, the prize will go to the alternate, who will also have 5 days to respond. Once the prize is offered to the alternate, the previous winner will lose the right to claim the prize.

AGUIRRE Y CÍA is exempt from any responsibility in the event of any error in the data provided by the winners / substitutes, which prevents their identification.

AGUIRRE Y CÍA reserves the right to declare the prizes void in the event that the winners or designated substitutes do not meet the requirements mentioned in these rules, as well as in the event that the winner and/or substitutes cannot be located.

5. Value and nature of the prize offered.

The prize will consist of an ELITE racket valued at €269.95. This is the racket belonging to our player Gemma Triay; with which she competes in official padel tournaments.

AGUIRRE Y CÍA is not responsible for any possible loss, damage, theft or any other circumstance attributable to the courier services that may affect the delivery of the prizes.

The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The Company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are problems of stock of the prize and, therefore, it is impossible to give the prize.

6. Information concerning the processing of personal data (in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

6.2. The purpose of the processing of personal data:

● Management of the participation in the giveaway "Gemma Triay: 3 palas ELITE", in the development of the same and in the designation of the winner/s.

● Publication of these on social networks and other means of dissemination.

To send subsequent promotions and marketing actions in order to disseminate and promote the activities of AGUIRRE Y CÍA.

6.3. Periods of conservation of the information: The identifying data of participants will be kept for the time strictly necessary for the development of the giveaway and during the legal periods which, where applicable, may be applicable. The data used for advertising and commercial prospecting will be kept indefinitely, unless the user requests (AGUIRRE Y CÍA) to unsubscribe.

6.4. Legal basis for processing: the legitimation for the processing of data is the consent given by the participant with the participation in the giveaway and, therefore, with the acceptance of these terms and conditions. However, in the event of withdrawal of consent, this shall not affect the lawfulness of any processing previously carried out.

6.5. International assignments and transfers: no assignment of data to third parties or international transfers will be carried out. AGUIRRE Y CÍA, as processor of the customer's data, may access and store the data (within the EU) in order to offer the services of its platform to the customer within the framework/agreement/contract established with the customer and only for that purpose.

6.6. 7. Sanctions in the event of fraudulent use.

Fraud is understood to be the use of independent platforms or applications to obtain votes or more participations in the giveaway, as well as behaviour that we detect as apparently abusive and/or malicious.

The detection of any of these practices will result in the cancellation of the participation.

AGUIRRE Y CÍA reserves the right to take legal action against those persons who carry out any type of act that could be considered as manipulation or falsification of the giveaway.

AGUIRRE Y CÍA is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the functioning of the application used to participate in the promotion, to the defrauding of the usefulness that users may have attributed to it and to the access to the different pages and sending of participation answers through the Internet.

8. Transfer of image rights and/or intellectual property. 

This giveaway is not linked to any social media platform or network.

Instagram does not sponsor, endorse or administer this promotion in any way, nor is it associated with it. The participant is providing his/her information and data to AGUIRRE Y CÍA and not to Instagram. 

9. Acceptance of the Legal Bases.

Participation in the giveaway implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, AGUIRRE Y CÍA will be released from the fulfilment of the obligation contracted with this participant.
