Legal terms and conditions of the "Master Final 22 rackets" giveaway
1. Identification of the organising company.
AGUIRRE Y CÍA., with registered office at Calle Trespaderne 29, 28042, Madrid and tax identification number B65576878, is organising the "Palas Master Final 22" giveaway.
2. Start and end dates of the giveaway and geographical scope.
The giveaway will start on Thursday 29 December 2022 at 16:00h and will end on Sunday 8 January 2023 at 23:59h. It will be possible to participate and/or vote only during this period of time.
AGUIRRE Y CÍA reserves the right to postpone or extend the giveaway period in case of force majeure, as well as the right to interpret these legal terms and conditions.
Participation is only possible from Europe.
3. Rules and conditions for participation.
The giveaway is open to individuals over 18 years of age and residing in Europe.
Employees of the company, family members of employees, fraudulent profiles and competition experts are not eligible to participate in the giveaway campaign and therefore cannot be winners.
Participation through agents or third parties or the use of multiple identities is also not permitted.
To enter, users must follow @bullpadelsport, @gemmatriay and @navarro_paquito on Instagram, like the post and mention three users. If the post is shared on Instastories, there will be more chances to win the giveaway.
Aguirre y CÍA reserves the right to make changes to the campaign during its development, if there is any cause that prevents it from being carried out successfully or in order to improve its progress.
4. Selection of the winner and mode of the draw.
The selection of the winners will take place on Monday 9 January 2023, through a platform that will certify that the selection has been random among the participants who meet the conditions.
There will be 2 winners and 2 alternates. A publication will be made in the Instagram Stories of Bullpadel announcing the name of the winners. Also, the winner will be contacted via email and we will send a personal email. If within 5 days has not responded, the prize will go to the alternate, who will also have 5 days to respond. Once the prize is offered to the alternate, the previous winner will lose the right to claim the prize.
AGUIRRE Y CÍA is exempt from any responsibility in the event of any error in the data provided by the winners / substitutes, which prevents their identification.
AGUIRRE Y CÍA reserves the right to declare the prizes void in the event that the winners or the designated substitutes do not meet the requirements mentioned in these rules, as well as in the event that the winner and/or substitutes cannot be located.
5. Value and nature of the prize offered.
The prize will consist of a HACK 03 MF racket valued at 449,95€ and an ELITE MF racket valued at 360,50€. These are the official rackets of the Final Master 2022 with which Gemma Triay and Paquito Navarro played.
AGUIRRE Y CÍA is not responsible for any possible loss, damage, theft or any other circumstance attributable to the courier services that may affect the delivery of the prizes.
The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. The Company reserves the right to modify the prize if, on the day of declaring the participant as the winner, there are problems of stock of the prize and, therefore, it is impossible to give the prize.
6. Information regarding the processing of personal data (in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

● Management of the participation in the "Palas Master Final 22" giveaway, in the development of the same and in the designation of the winner/s.
● Publication of these on social networks and other means of dissemination.
To send subsequent promotions and marketing actions with the aim of disseminating and promoting the activities of AGUIRRE Y CÍA.

Information retention periods: The identifying data of participants will be kept for the time strictly necessary for the development of the giveaway and during the legal periods which, where applicable, may be applicable. The data used for advertising and commercial prospecting will be kept indefinitely, unless the user requests AGUIRRE Y CÍA to unsubscribe.

Legal basis for the processing: The legitimisation for the processing of data is the consent given by the participant with the participation in the giveaway and, therefore, with the acceptance of these terms and conditions. However, in the event of withdrawal of consent, this shall not affect the lawfulness of any processing previously carried out.
6.5. International assignments and transfers: no assignment of data to third parties or international transfers will be carried out. AGUIRRE Y CÍA, as processor of the customer's data, may access and store the data (within the EU) in order to offer the services of its platform to the customer within the framework/agreement/contract established with the customer and only for that purpose.

Rights of the Participant: Data subjects may exercise their rights of access, rectification, erasure, portability and limitation or opposition of the data in the cases and to the extent set out in the GDPR EU 2016/679. 7. Penalties in case of fraudulent use.
Fraud is understood to be the use of independent platforms or applications to obtain votes or more participations in the giveaway, as well as behaviour that we detect as apparently abusive and/or malicious.
The detection of any of these practices will result in the cancellation of the participation.
AGUIRRE Y CÍA reserves the right to take legal action against those persons who carry out any type of act that could be considered as manipulation or falsification of the giveaway.
AGUIRRE Y CÍA is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the functioning of the application used to participate in the promotion, to the lack of usefulness that users may have attributed to it and to the access to the different pages and the sending of participation answers through the Internet.
8. Transfer of image rights and/or intellectual property.
This giveaway is not linked to any platform or social network.
Instagram does not sponsor, endorse or administer this promotion in any way, nor is it associated with it. The participant is providing his/her information and data to AGUIRRE Y CÍA and not to Instagram.
9. Acceptance of the Legal Bases.
Participation in the giveaway implies acceptance of these legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, AGUIRRE Y CÍA will be released from the fulfilment of the obligation contracted with this participant.
